Listed SA Terms & Conditions

This page sets out the terms and conditions ("Terms") under which you may use the website listedsa.com and all related applications and services (together, the "Platform"). The Platform is owned and operated by [Insert registered company name], registration number 2026/531909/07 ("Listed SA", "we", "us", or "our").

1. "You" and "user" refer to any individual or entity accessing the Platform.
2. "Platform" refers to listedsa.com and any related applications or services operated by Listed SA.
3. "Listing Service" refers to the property listing functionality described in Section 8 below.

By using the Platform, you accept these Terms in full. We may revise these Terms at any time by updating this page. Please check this page periodically, as continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

1. You may not use the Platform to transmit, distribute, store, or destroy material that:
   • violates any applicable law or regulation;
   • infringes the copyright, trademark, trade secret, or other intellectual property rights of any person, or violates the privacy or other personal rights of others; or
   • is defamatory, obscene, threatening, abusive, or hateful.
2. You may not:
   • use any robot, spider, scraper, or other automated means to access, monitor, or copy any part of the Platform;
   • interfere with or attempt to interfere with the proper functioning of the Platform;
   • impose an unreasonable or disproportionate load on our infrastructure;
   • copy, reproduce, modify, or create derivative works from any content on the Platform without our prior written permission;
   • reverse-engineer or attempt to discover the source code of the Platform, except to the extent expressly permitted by law; or
   • access any part of the Platform that you are not authorised to access.

1. All content, trademarks, and data on the Platform, including software, databases, text, graphics, icons, and designs, are owned by or licensed to Listed SA.
2. No licence or other right, including under copyright, trademark, patent, or other intellectual property law, is granted to you in respect of that content.

1. You may not attempt to violate or compromise the security of the Platform, including by:
   • accessing data, servers, or accounts you are not authorised to access;
   • probing, scanning, or testing the vulnerability of the Platform without authorisation;
   • interfering with service to any user or system, including through viruses, overloading, flooding, or spamming;
   • sending unsolicited communications through the Platform; or
   • forging header information in any communication sent through the Platform.
2. Violations of this section may result in civil or criminal liability. We may investigate suspected violations and cooperate with law enforcement authorities where appropriate.

1. The Platform hosts property listings and related content submitted by third parties. Listed SA is not involved in the buying, selling, or renting of any property listed, and is not a party to any agreement concluded between users.
2. Listed SA is not responsible for any decisions made, or agreements entered into, by users in connection with listings, enquiries, or any other content on the Platform.
3. While we take reasonable steps to maintain the integrity of the Platform, we do not warrant that it will be error-free or free of viruses or other harmful code.
4. To the fullest extent permitted by law, Listed SA will not be liable for any costs, losses, or damages of any nature arising from your use of, or inability to use, the Platform.
5. The Platform may contain links to third-party websites. We do not control and are not responsible for the content or practices of any linked third-party website.

1. If you use the Listed SA property listing service (the "Listing Service"), the following additional terms apply.
2. Listed SA is not, and does not hold itself out to be, an estate agent as defined in the Estate Agency Affairs Act, 1976 (as amended), or an attorney, conveyancer, financial adviser, tax adviser, mortgage bond originator, or valuer.
3. Listed SA has no authority to negotiate or conclude any agreement on your behalf. You are solely responsible for all obligations and consequences arising from any negotiation or agreement you enter into as a result of using the Listing Service. You are strongly encouraged to make your own enquiries and seek advice from a qualified professional before concluding any transaction.
4. You use the Listing Service at your own risk.
5. You may not submit material through the Listing Service that is unlawful, harmful to minors, fraudulent, false or misleading, infringes any third-party right, or is defamatory or obscene.
6. You are solely responsible for all material you submit. We may, at our discretion and without notice, refuse or remove any material we consider to be in breach of these Terms.
7. You must submit material in the format we specify from time to time.
8. We may, without notice, monitor or moderate material submitted to the Listing Service, and may restrict or suspend any user's access to it.
9. We are not responsible for the accuracy of material submitted by users, and do not endorse any listing or property.
10. You grant Listed SA a perpetual, royalty-free, transferable licence to publish material you submit through the Listing Service.
11. You must comply with all applicable laws in connection with your use of the Listing Service, including (without limitation) the Consumer Protection Act, 2008 and the Alienation of Land Act, 1981.
12. Listings must be submitted in English to maintain a consistent experience for all users of the Platform.

1. Listing packages may be purchased through the Platform using our third-party payment gateway. By making a payment, you agree to the terms of that payment gateway provider in addition to these Terms.
2. You agree to pay all fees applicable to the listing package you select. Fees are due at the time of purchase unless otherwise stated.
3. Except as required by law or as otherwise stated at the time of purchase, fees are non-refundable once a listing has been published.
4. If a payment is not successfully processed, we may suspend or decline to publish the relevant listing until payment is received.

1. These Terms constitute the entire agreement between you and Listed SA in relation to your use of the Platform. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
2. If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.

The Platform is hosted, controlled, and managed from the Republic of South Africa. These Terms, and any matter relating to your use of the Platform, are governed by the laws of South Africa.

Any dispute arising out of or relating to these Terms or your use of the Platform will be resolved through arbitration conducted in English, in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA). The arbitration will be held in Durban, South Africa, and the unsuccessful party will bear the reasonable costs of the successful party in connection with the arbitration.

Listed SA is committed to responsible and ethical advertising practices, including in respect of third-party advertisers on the Platform. We will investigate and, where appropriate, remove any content that is reported as hateful, misleading, or discriminatory.
