Listed SA — PPRA Guidelines

These guidelines explain how property practitioners — estate agents, agencies, and related professionals — should use Listed SA in line with the Property Practitioners Act 22 of 2019 ("the Act") and the rules of the Property Practitioners Regulatory Authority ("PPRA"). They are intended to help you list property responsibly on our Platform. They do not replace your legal obligations under the Act or the PPRA Code of Conduct, and you remain responsible for your own compliance.

Listed SA's role

Listed SA is an online property listings platform. We are not an estate agent, property practitioner, or party to any sale, purchase, or lease agreement concluded between users. We do not hold mandates, negotiate on behalf of sellers or landlords, or provide conveyancing, financial, or legal advice.

Property practitioners who publish listings on Listed SA do so in their own name or on behalf of their agency, and remain fully responsible for the accuracy of their listings and for compliance with applicable law.

Who these guidelines apply to

These guidelines apply to any user who lists property on Listed SA in a professional capacity, including:

  • registered estate agents and candidate estate agents;
  • property agencies and franchisees;
  • developers or other property practitioners marketing immovable property for sale or rent; and
  • company administrators listing on behalf of an agency or franchise.

Private sellers and landlords who are not property practitioners are not subject to PPRA registration requirements, but must still provide accurate information and comply with our Terms & Conditions.

Registration and fidelity fund certificate

A property practitioner may only render property practitioner services if registered with the PPRA and in possession of a valid fidelity fund certificate ("FFC"), unless exempt under the Act.

  • You must hold a current FFC before listing property on Listed SA in your capacity as a property practitioner.
  • Your agency profile and listings should reflect your registered legal name as it appears on your FFC and company registration, not only a trading name.
  • Listed SA may request proof of PPRA registration or a valid FFC as part of our agent or company verification process.
  • You must not list property on behalf of another practitioner who is not registered or who does not hold a valid FFC.

Mandates and authority to list

  • You may only publish a listing if you hold a valid written mandate from the seller or landlord, or are otherwise lawfully authorised to market the property.
  • The listing price or rental must match the price or rental agreed with the seller or landlord in your mandate. You must not advertise a property at a price or rental that has not been authorised.
  • Before concluding a mandate, you must provide the seller or landlord with the mandatory disclosure form prescribed under the Act and ensure it is completed and signed where required.
  • You must provide the mandatory disclosure form to prospective purchasers or lessees before they make an offer, in accordance with the Act.
  • If a mandate is withdrawn, expired, or the property is no longer available, you must promptly update or remove the listing on Listed SA.

Advertising and marketing requirements

All property listings and related marketing on Listed SA are considered marketing material for purposes of the Act. When publishing listings, you must:

  • Include the prescribed wording "Registered with the PPRA" on your agency profile, agent profile, or listing content where applicable.
  • Clearly identify yourself or your agency as the property practitioner marketing the property. Listings must not create the impression that they were placed directly by the owner, seller, or landlord unless that is factually correct and permitted.
  • If you operate as a franchisee, clearly and unambiguously disclose that you operate in terms of a franchise agreement and state the name of the franchisor, using your registered legal name (for example: "First Realty (Pty) Ltd, a franchisee of [Franchisor Name]").
  • If a candidate estate agent is associated with a listing, clearly state that the person is a candidate estate agent.
  • Ensure photographs, descriptions, floor plans, and other media accurately represent the property and are used with the rights holder's permission.

Accuracy, honesty, and fair marketing

You must not, through your listings or conduct on Listed SA:

  • make false, misleading, or exaggerated statements about a property or transaction;
  • withhold material information that a reasonable consumer would expect to know;
  • use harmful, misleading, or undesirable marketing techniques;
  • discriminate unlawfully in the marketing or letting of property;
  • reuse or duplicate listings for properties that are no longer available; or
  • advertise properties you are not mandated or authorised to market.

Listings must be kept up to date. Status changes — such as sold, let, under offer, or withdrawn — should be reflected promptly.

Enquiries and consumer communication

  • Respond to enquiries received through Listed SA promptly, honestly, and professionally.
  • Do not use consumer contact details obtained through the Platform for unsolicited marketing unrelated to the enquiry, unless permitted by law and the consumer's preferences.
  • Handle personal information in accordance with POPIA and our Privacy Policy.
  • On request, be able to provide a consumer with a copy of the PPRA Code of Conduct, as required under the Act.

How Listed SA supports compliance

Listed SA may take steps to promote a trustworthy marketplace, including:

  • reviewing and moderating listings before or after publication;
  • verifying agents, agencies, and companies where requested or required;
  • removing or suspending listings that appear inaccurate, unlawful, or in breach of these guidelines;
  • restricting or suspending accounts that repeatedly breach our policies; and
  • cooperating with the PPRA or other authorities where lawfully required.

Our moderation processes support compliance but do not relieve you of your independent obligations under the Act.

Consequences of non-compliance

Breaches of the Act or PPRA rules may result in fines, disciplinary action, or other sanctions imposed by the PPRA. In addition, Listed SA may remove listings, revoke verification, suspend accounts, or terminate access to the Platform where we reasonably believe a user has breached these guidelines or our Terms.
